民法第440條
承租人租金支付有遲延者,出租人得定相當期限,催告承租人支付租金,
如承租人於其期限內不為支付,出租人得終止契約。
租賃物為房屋者,遲付租金之總額,非達兩期之租額,不得依前項之規定
,終止契約
所以你就直接終止契約,並要求返還所積欠之費用
再向法院民事執行處聲請強制執行要求對方遷出,
這時法院就會指派警察用公權力強迫對方搬離。
對了通常這種案件訴訟不會拖很久啦
支付命令+強制執行 差不多1~2個月左右就可以了
